States Challenge USDA Funding Conditions
March 24, 2026
Multiple state attorneys general, including those from Massachusetts, Washington, Oregon, and Michigan, have filed lawsuits against the U.S. Department of Agriculture (USDA) challenging the imposition of new funding conditions tied to immigration, diversity, equity, inclusion, and gender identity. These conditions, effective December 31, 2025, threaten billions of dollars in critical federal funding for essential USDA programs such as the school lunch program, WIC, SNAP, TEFAP, and the Volunteer Fire Capacity Program. The lawsuits argue that these conditions are unconstitutional, vague, and coercive, potentially disrupting funding streams that support vulnerable populations nationwide.
- Why this matters: Procurement professionals should be aware that ongoing legal challenges may impact the availability and terms of federal USDA funding for nutrition and assistance programs.
- Agencies and contractors involved in these programs may face uncertainty or delays in funding allocations due to litigation outcomes.
- Organizations supporting these programs should evaluate risk exposure related to compliance with the contested funding conditions.
- Businesses providing services or products to USDA-funded programs should monitor developments to adjust contract planning and resource allocation accordingly.
These federal grant programs are a lifeline for families across Massachusetts. I know that firsthand, as my own family relied on these programs when I was growing up. They ensure that children have access to meals at school, families can cover basic necessities, seniors can stretch limited incomes, and rural communities have critical support. These are vital investments in the health, stability, and wellbeing of our communities. Our lawsuit asks the court to block the USDA from imposing illegal conditions that would threaten funding for these programs.

The Trump administration is once again trying to pressure states into complying with vague and unlawful conditions by threatening to withhold essential federal funding. We’ve challenged and defeated these tactics before and are fully prepared to do it again to ensure Michiganders receive the assistance they need to feed their families.
— Dana Nessel, Michigan Attorney General
In an affordability crisis, threatening to withhold food assistance from kids and vulnerable families is heartless—and against the law.
