ED Enforces Title IX Compliance at San Jose State
March 25, 2026
The U.S. Department of Education's Office for Civil Rights (OCR) has issued a Letter of Impending Enforcement to San Jose State University (SJSU) for failing to comply with Title IX regulations concerning gender participation in women's sports and access to female-only facilities. The university has been given a 10-day deadline to implement corrective measures or face enforcement actions that could include the loss of federal funding. This enforcement action underscores the federal government's commitment to upholding Title IX compliance and signals increased scrutiny on educational institutions' policies related to gender equity.
- Procurement and compliance officers at educational institutions should review and update policies to ensure adherence to Title IX requirements to avoid funding risks.
- Vendors providing compliance consulting, legal services, or policy advisory to universities may see increased demand as institutions seek to align with federal mandates.
- Federal funding recipients must prioritize Title IX compliance in contract and grant management to mitigate enforcement risks.
- This action highlights the importance of proactive engagement with OCR guidelines and timely response to enforcement communications to maintain eligibility for federal programs.
We have provided SJSU with multiple opportunities to resolve its Title IX violations with common sense actions: separating male and female athletes based on their biological sex, keeping men out of womenโs locker rooms and bathrooms, restoring rightfully-earned titles and accolades to female athletes, and apologizing to the women forced to forfeit competitions to protect themselves. Yet, SJSU remains obstinate, choosing a radical ideology over safety, dignity, and fairness for its own students.
