Delaware House Passes Fireworks Safety Legislation
March 17, 2026
Delaware's House of Representatives has passed House Bill 63 to strengthen safety regulations governing the use and sale of consumer fireworks. The legislation mandates retailer registration, requires advertising warnings, increases penalties for violations, and allocates funding to the Office of the State Fire Marshal to enhance enforcement and public education efforts. This law aims to reduce injuries, fires, and property damage related to fireworks, addressing concerns about illegal use and misleading advertising from out-of-state sellers.
- Procurement professionals should anticipate increased demand for enforcement resources and educational materials funded through the State Fire Marshal's office.
- Vendors and contractors specializing in public safety equipment, signage, and outreach services may find new opportunities to support compliance and awareness programs.
- State agencies and local governments will need to integrate these regulatory changes into procurement planning for fire prevention and community safety initiatives.
- Organizations involved in regulatory compliance and public safety should evaluate how these enhanced requirements impact vendor qualifications and contract specifications in Delaware.
House Bill 63 is an excellent opportunity to increase fire and life safety throughout the State of Delaware by raising awareness and understanding of consumer fireworks. I would like to thank the General Assembly for their consideration of this bill, and special thanks to Representative Madinah Wilson-Anton and her staff for all the time and work in composing this bill.
— John W. Rudd, Delaware State Fire Marshal
The widespread, illegal use of fireworks in Delaware has been an issue for some time now. I was first alerted to the issue by members of my community, and after reaching out to the State Fire Marshal, I learned that the issue is due to a lack of public awareness of state law on fireworks and misleading advertisements from out-of-state retailers.
— Rep. Madinah Wilson-Anton
The Delaware Commission of Veterans Affairs is pleased to see HB 63 pass the House. While this bill focuses on fireworks regulations, it also reflects an important commitment to public safety 6 including the wellADbeing of our veterans, many of whom live with PTSD or other serviceADrelated conditions.
