Erie County Terminates ICE Detainee Housing Contract
March 17, 2026
Erie County Council voted on February 26, 2026, to terminate the contract with U.S. Immigration and Customs Enforcement (ICE) for housing federal immigrant detainees at Erie County Prison. This decision reflects local concerns about the facility's capacity, budget overruns, and community values regarding immigrant treatment. The termination signals a shift in the county's use of its detention facilities and impacts ongoing federal-local detention agreements. Concurrently, Erie County approved budget appropriations for community grants, a new Community Engagement Officer, and a Re-Entry program within Adult Probation, indicating a focus on community support and reintegration services.
- Procurement professionals should note the termination of the ICE housing contract at Erie County Prison, which may open opportunities for alternative detention or community service contracts.
- The county's budget reallocations toward community engagement and re-entry programs suggest potential contracting needs in social services and probation support.
- Vendors currently engaged with Erie County, such as the Regional Science Consortium (sole vendor for health-related contracts), may see shifts in county priorities affecting future solicitations.
- This development highlights the importance of monitoring municipal decisions that affect federal contract partnerships and local facility usage, especially in detention and community services sectors.
This ordinance does not end cooperation with federal criminal law enforcement. It does not prevent prosecution of crimes at any level and it will not, as the County Executive renegotiates this contract, create a budget gap to be filled by the taxpayers of Erie County. It simply says that our local jail, funded by Erie taxpayers, will not be used as an extension of an unruly federal immigration detention system.
— Jim Wertz, Councilman
Our facility was never designed to have another 600 people staying nine and a half days on average. We never had the staff to handle the previous population in 2024 when the prison went over budget illegally by $2 million of expenditures. I clearly object this on moral grounds and did a year ago, February, and it is not predicated on recent events. This is something we've thought about and talked about as a body for over a year.
— Copeland, Councilman
When Erie County agrees to house ICE detainees, even briefly, it sends a clear message. It tells immigrant families that the place where they call police for help, or to report crimes for safety, where they pay taxes, send their children to school, work hard to pay bills and provide for their loved ones, that same county is also participating in their detention.
