The USPTO plans to award a sole-source BPA for real estate planning and GSA space-assignment consultation across its portfolio. - Agency: U.S. Patent and Trademark Office (USPTO), Department of Commerce. - Procurement: Firm-fixed-price blanket purchase agreement (BPA) for portfolio-wide real property planning and management support, including consultation on pending General Services Administration (GSA) space-assignment actions. - Intended vendor: FD Stonewater, LLC (FDS). - Competition approach: The notice states the USPTO intends to use its Alternative Competition Method under the Patent and Trademark Office Acquisition Guidelines and the Patent and Trademark Office Efficiency Act. An earlier request for information received two legitimate small-business responses. - Notice status: This is a notice of intent, not a request for competitive proposals; no public competitive solicitation is planned. Questions are to be submitted in writing to the listed points of contact. - Quantities and value: No quantities, service part numbers, or estimated contract value are provided.

Description

The subject requirement is being procured using the Alternative Competition Method in accordance with the Patent and Trademark Office Acquisition Guidelines (PTAG), 78 Fed. Reg. 61185 (October 3, 2013), and the Patent and Trademark Office Efficiency Act (PTOEA) 35 U.S.C. § 2(b)(4)(A).

As a result of its exemptions, the USPTO is not required to meet the test of “full and open competition” as defined in FAR Part 6 and may use agency-specific acquisition procedures as described below when the circumstances warrant it and it is in the best interest of the agency to do so.

Consequently, USPTO intends to make a sole source BPA Award to support its portfolio-wide real property planning as well as specific GSA consultation support for pending GSA space assignment actions across the USPTO portfolio.  After previously posting an RFI (ACQ-27-0182) to sam.gov which closed on 9/24/26, USPTO received 2 legitimate small business responses and have identified FD Stonewater, LLC (FDS); 1001 N. 19th Street, Suite 1401, Arlington, VA 22209; UEI:L26UHZU1XC37 as the contractor able to most likely meet the agency’s needs for this requirement.

As a result, per (PTOEA) 35 U.S.C. 2(b)(4)(A  as further defined in PTAG 6.1.1 (d) USPTO intends to negotiate and award a firm fixed BPA with FDS  to meet this requirement.

This notice of intent is not a request for competitive proposals, nor will solicitation be issued to the public. Any questions regarding this notice must be submitted in writing via email to the following point of contact (POC) and alternate point of contact no later than 9:00 AM ET on Wednesday, October 28, 2026
