The EPA Region 10 proposal would delegate selected air-emissions rule implementation and enforcement responsibilities to the Northwest Clean Air Agency. - Government buyer: Environmental Protection Agency (EPA), Region 10. - Agency receiving delegated authority: Northwest Clean Air Agency (NWCAA), a Washington State local air agency. Washington State Department of Ecology is also identified as retaining certain authorities. - Procurement status: This is a proposed regulatory action, not a request to purchase products or services; no OEMs, vendors, or product quantities are identified. - Proposed delegation: Update delegation of certain New Source Performance Standards (NSPS) under 40 CFR part 60 and approve delegation of certain National Emission Standards for Hazardous Air Pollutants (NESHAP) under 40 CFR parts 61 and 63. - The covered standards and amendments are those incorporated by reference by NWCAA through the specified cutoff in the notice. - If finalized, NWCAA would be the primary implementing and enforcement agency for the delegated standards. - Important limitations: The delegation would exclude Indian country, nondelegable authorities, and standards or subparts retained by the Washington State Department of Ecology.
Description
The EPA is proposing to update the delegation of certain New Source Performance Standards (NSPS) and approve the delegation of certain National Emission Standards for Hazardous Air Pollutants (NESHAP) to the Northwest Clean Air Agency (NWCAA) in Washington State. NWCAA submitted updated regulations incorporating by reference certain EPA standards as they existed through October 18, 2023. The delegation would support implementation and enforcement of the covered standards, but would not apply to sources or activities in Indian country. Comments must be received by November 18, 2026.
