Description
The Environmental Protection Agency is finalizing a three-year extension to the compliance date for Clean Water Act Hazardous Substance Facility Response Plans. The requirements apply to onshore non-transportation-related facilities that could reasonably be expected to cause substantial environmental harm from a worst-case discharge of a CWA hazardous substance to navigable waters, adjoining shorelines, or the exclusive economic zone. The rule also removes references to climate change and environmental justice from the FRP requirements to align with Executive Order 14148. The final rule is effective December 14, 2026.
