Description

This final rule adjusts fees charged by U.S. Citizenship and Immigration Services for EB-5 immigration benefit requests. It also codifies provisions of the EB-5 Reform and Integrity Act of 2022, implements statutory requirements, and responds to comments on the proposed fee rule. The rule establishes an updated fee schedule, introduces a technology fee, and codifies Integrity Fund fees and penalties. It is effective November 30, 2026; applications, petitions, or requests postmarked on or after that date must include the new fees.
