The U.S. Environmental Protection Agency (EPA) published a final rule on June 1, 2026, titled "Rescission of Title V Emergency Affirmative Defense Rule." After publication, typographical errors were discovered in the regulatory text related to 40 CFR parts 70 and 71. This document corrects those errors to ensure the restored regulatory text matches the original text prior to removal following the 2023 Affirmative Defense Rule. The corrections do not substantively affect the emergency affirmative defense provisions. The rule is effective September 29, 2026.
