Notice of Intent for Sole Source

The Environmental Protection Agency (EPA) in Research Triangle Park (RTP) in Durham, North Carolina intends to award, on a sole source basis, and in accordance with RFO 6.103-1(b), a contract to AB SCIEX LLC for a Protective Equipment Maintenance Agreement (EMA) for the X500R Mass Spectrometer. This procurement is recommended to be processed without full and open competition.

EPA’s Office of Chemical Safety and Pollution Prevention (OCSPP) Office of Mission Critical Operations, Risk Assessment Support Division’s Laboratory is needing a Protective EMA for the X500R Mass Spectrometer, which is needed to ensure proper equipment performance and reliability. This instrument is vital to generate data for many aspects of OCSPP’s mission to gain knowledge about chemicals and their associated effects on human health and the environment.

The AB SCIEX LLC Protective EMA for the X500R Mass Spectrometer shall include:

Service and maintenance that enables the equipment to operate and perform according to manufacturer’s specifications, without deviation. Documented verification that, after maintenance, instrument operation is fully consistent with manufacturer’s specifications, without deviation. Service by highly trained engineers who are factory trained and currently certified on the relevant systems by the instrument manufacturer to have the expertise necessary to maintain the systems. Replacement of components that cannot be repaired. Parts, labor, and travel for remedial repairs at no additional charge. Two preventative maintenance visits per year for the X500R QTOF mass spectrometer. One preventative maintenance visit per year for the LC system and gas generator. Use of certified AB Sciex replacement parts for optimal instrument performance. Use of replacement parts manufactured by AB Sciex or by AB Sciex’s partner vendors. Use of new or factory remanufactured replacement parts only. Response time of 48 hours or less for initiation of service (excluding weekends). Telephone and e-mail access for instrument technical support: Telephone and e-mail access for application support. System software (Analyst or OS software) maintenance and technical support (on-site, or by telephone or e-mail) for the X500R QTOF Mass Spectrometer, including version upgrades, online training, support for software use for installation, configuration, accessing and installing patches, instrument operations, data processing, accessing or developing scrips or macros, and templates.

This Notice of Intent is not a request for proposals. This notice of intent is for information purposes only; therefore, no solicitation will result from this announcement. The intended contract will be awarded as a one year contract with two (2) - 12 month option periods.

All capability statements received within 15 days after publication of this notice will be considered by the Government. Responses must be supported with clear and convincing evidence to clearly be able to provide theservices outlined and itemized pricing that is sufficient to make a determination that competition is feasible. A request for documentation will not be considered as an affirmative response. A determination by the Government not to compete based on responses to this notice is solely within the discretion of the Contracting Officer. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement.
