The U.S. Environmental Protection Agency (EPA) is proposing to repeal a final rule published in December 2024 that partially approved and partially disapproved North Dakota's 2022 regional haze State Implementation Plan (SIP) for the second implementation period. The EPA is proposing to approve the portions of the SIP that were previously disapproved. This action follows petitions for reconsideration and review filed by the State of North Dakota and other stakeholders, with the EPA granting reconsideration and the court holding petitions in abeyance pending administrative reconsideration. Comments on this proposal must be received by October 9, 2026.
