Description
The Securities and Exchange Commission (SEC) is seeking public comment on the proposed extension of the collection of information related to Rule 489 and Form F-N. This rule requires foreign banks, foreign insurance companies, and their subsidiaries exempted from the definition of investment company to file Form FN to appoint an agent for service of process when making a public offering of securities in the United States. The information collected allows the SEC and private plaintiffs to serve process on foreign entities in securities-related actions and administrative proceedings. The SEC estimates an annual burden of 20 hours based on an average of 20 filings per year. Comments are invited on the necessity, accuracy, and ways to minimize the burden of this information collection.
