Notice of Intent to Award a Sole-Source Contract ModificationSubject: Notice of Intent to Sole Source – 6-Month Extension for Research Triangle Park, North Carolina Operations and Maintenance ContractReference No: 68HERD21D0001The U.S. Environmental Protection Agency (EPA) intends to award a non-competitive 6-month extension on a sole-source basis to VGS Infrastructure Services under the authority of 41 U.S.C. 3304(a)(1) as implemented by FAR 6.103-1, "Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements."The current contract, 68HERD21D0001, provides Operations and Maintenance Support Services for the EPA Research Triangle Park campus in North Carolina. The contract extension is necessary due to unforeseen delays the Agency has encountered with reprocuring the successor contract. To support the continued operational and maintenance needs at the facility, the Government requires a 6-month bridge extension to prevent a critical lapse in services. This short-term extension will be executed pursuant to FAR 52.217-8, Option to Extend Services. Because the pricing for this option was not evaluated during the original competition, this contract action is being treated as a non-competitive, sole-source procurement. The estimated Period of Performance for the extension is October 1, 2026 – March 31, 2027.The contractor is required to continue providing facilities operations, maintenance and support services on a twenty-four-hour, seven-day-a-week basis at the facilities on the campus. This includes providing comprehensive management, training, licensed personnel with facility access, tools, and labor necessary to perform all functions, operations, and tasks, in accordance with all applicable industry performance standards, to include but not be limited to, National, state and local codes; OSHA regulations; Federal specifications; EPA facility standards; and EPA-RTP policies and procedures. VGS is the only source capable of providing these services without interruption. Due to the critical nature of the RTP facilities operation and maintenance support services provided via this contract, a lapse in services cannot occur. Any interruptions to the services required to maintain buildings on the campus that house active laboratories present unacceptable operational and safety risks to the Agency and employees who occupy these spaces.This notice is being posted in accordance with FAR Subpart 5.101 and is NOT intended to solicit competitive proposals or quotes. A determination by the Government not to compete this proposed action based upon responses to this notice is solely within the discretion of the Government.
