Description
The USACE Omaha District intends to negotiate on a sole source basis for a contract modification to HCPA-GARCO JV1 in accordance with Federal Acquisition Regulations (FAR) 6.302-1, Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements. The modification is to remediate and render inert the existing underground storage tanks that have been rendered obsolete with the construction of the new Emergency Power Plant – Fuel Storage (EPP-FS) storage tanks. These Underground Storage Tanks (USTs) will need to be remediated and removed or rendered inert within a certain time period (determined by the North Dakota Tank Program Office) once EPP-FS construction is complete. Compliance with state and federal regulatory requirements, to include testing, permitting, and reporting, will be required. Additional work may include repairs to the existing underground vault housing the USTs, remediation of contaminated soils, removal of existing mechanical equipment, and associated grading and site work. The work is similar in nature to existing requirements in the contract and the contractor is currently performing a broad scope of both new construction and existing equipment integration as part of the contract. The current contract includes UST construction with associated mechanical, electrical, and plumbing equipment, along with earthwork, and concrete. The contractor, HCPA-Garco JV, will be able to perform the entirety of the work within their current purview. The total value of current contract and executed work is approximately $19,129,000.00. The additional work is estimated to be between $500,000 and $1,000,000. This amount is approximately between 2.6% and 5.2% of the current contract and additional time specific to this modification will be added to the current contract as needed and based upon negotiations.
THIS NOTICE IS NOT A REQUEST FOR COMPETITIVE PROPOSALS and no solicitation will be issued; however, any System for Award Management (SAM) registered firm that can meet the requirement may give a written notification to the Contracting Officer in the form of a capability statement, including an explanation how the contractor would be able to effectively and efficiently operate in the same footprint as the Determination of Responsibility (DOR) contractor at the same time. Responses must be provided by 03 September 2:00 PM CENTRAL. A determination by the Government not to compete this procurement will be based on market research, including responses to this notice. It is within the Government's sole discretion to decide whether the information received in response to this notice warrants development of an alternative approach or not. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement. The USACE, Omaha District, will not reimburse any firm for developing a response to this notice. The NAICS code is 237120 and the size standard is $45M.
