Notice of Intent – Sole Source Acquisition

The National Institutes of Health (NIH) intends to award a Firm-Fixed-Price Purchase Order to Bruker Biospin Corporation for a Maintenance Agreement for five (5) Bruker CryoPlatform™ CCU4 systems and four (4) Bruker CryoPlatform™ CCU5 systems.
The Government intends to solicit from a single source in accordance with FAR 6.302-1, Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements, because the circumstances of this acquisition indicate that only one responsible source is capable of satisfying the Government's requirements.
Bruker Biospin Corporation is the only known responsible source capable of meeting the Government's specific technical and functional requirements.
The National Institute of Diabetes and Digestive and Kidney Diseases (NIDDK) operates eleven (11) Bruker Nuclear Magnetic Resonance spectrometers that support critical research programs focused on protein structure, molecular interactions, Human Immunodeficiency Virus, diabetes, and neurodegenerative diseases. These instruments rely on Bruker CryoPlatform™ cryogenic cooling systems to maintain proper operation of the cryogenic probes. Due to the highly specialized and proprietary design of the CryoPlatform™ systems, periodic preventive maintenance and repair services are required to ensure reliable performance, minimize instrument downtime, and protect critical research activities. Maintenance must be performed using manufacturer-approved procedures and components to maintain system integrity and operational performance.
Bruker Biospin Corporation is the manufacturer of the CryoPlatform™ systems and is the only known source capable of providing the factory-trained engineers, proprietary replacement parts, software, and technical support required to maintain and repair this equipment. Because the systems incorporate proprietary components and specialized technology, Bruker Biospin Corporation is uniquely qualified to perform the required services and ensure the equipment continues to operate in accordance with manufacturer specifications. Use of a non-authorized service provider could compromise system performance, increase the risk of equipment damage, and potentially affect manufacturer support.
Based on the Government's requirements, Bruker Biospin Corporation is the only known responsible source capable of providing the required maintenance and repair services while maintaining the equipment in accordance with manufacturer specifications and supporting the continuity of ongoing research activities.
This notice is not a request for competitive quotations. However, interested sources that believe they can satisfy the Government's requirements may submit a capability statement demonstrating their ability to provide all required maintenance and repair services.
The Government will consider all timely responses received and will determine whether the acquisition should proceed as a single-source procurement or be competed.
The Government anticipates making an award approximately five (5) calendar days after the closing date of this notice, unless the Government determines that another responsible source is capable of meeting the requirement.
