Maintenance Agreement – Hitachi S-4800 Scanning Electron Microscope with Three (3) Option Years Notice No.: 75N98026Q01040 The National Institutes of Health (NIH) intends to award a Firm-Fixed-Price Purchase Order to Hitachi High-Tech America for a maintenance agreement for the Government-owned Hitachi S-4800 Scanning Electron Microscope. In accordance with FAR 6.302-1, Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements, Hitachi High-Tech America is the only known responsible source capable of providing the required maintenance and repair services that meet the Government's requirements. No other source has been identified that can provide the complete maintenance services required under this agreement. The Hitachi S-4800 Scanning Electron Microscope is a specialized instrument requiring manufacturer-specific maintenance, technical expertise, parts, and components. The Government requires maintenance services that are compatible with the equipment and capable of maintaining the instrument in proper operating condition. The Government understands that service by unauthorized third parties may affect the manufacturer's warranty and/or the manufacturer's ability to support the instrument. The objectives of the maintenance agreement are as follows: 1.    Parts and Components: The contractor shall provide all spare parts and components necessary to service and maintain the Hitachi S-4800 Scanning Electron Microscope, provided that the instrument has not been modified or altered by the user in a manner that prevents or adversely affects the contractor's ability to perform the required services. 2.    Emergency Service: The contractor shall provide unlimited on-site emergency service in the event of failure or malfunction of the Hitachi S-4800 Scanning Electron Microscope. The contractor's response time shall be within 48 hours of the Government's request for service. 3.    Preventive Maintenance: The contractor shall provide one (1) preventive maintenance service during each period of performance. Preventive maintenance shall include, as applicable, cleaning; replacement of vacuum oils, seals, filters, and hoses; inspection and servicing of air and water lines; adjustment of systems; and alignment of columns. 4.    Parts and Labor: All parts and labor required to perform the covered maintenance and repair services shall be included in the maintenance agreement. This notice is not a request for competitive quotations. Hitachi Microscopy is the intended source for this requirement. However, interested small business concerns, including 8(a) participants, Service-Disabled Veteran-Owned Small Businesses (SDVOSBs), HUBZone small businesses, Small Disadvantaged Businesses (SDBs), Veteran-Owned Small Businesses (VOSBs), and Women-Owned Small Businesses (WOSBs), may submit a written capability statement demonstrating their ability to meet the Government's requirement. Capability statements shall clearly demonstrate the firm's ability to provide all required maintenance, preventive maintenance, emergency service, parts, and labor for the Hitachi S-4800 Scanning Electron Microscope. A determination by the Government to compete this proposed acquisition based upon responses received to this notice is solely within the discretion of the Government. It is anticipated that an award will be issued approximately five (5) calendar days after the closing date of this notice, unless the Government determines that another vendor has the capability to meet this requirement.
