DEA Proposed Rule to List Esters of 3,4-MDP-2-P Methyl Glycidic Acid as List I Chemicals

The Drug Enforcement Administration (DEA), under the Department of Justice, is proposing a regulatory amendment to expand the listing of 3,4-MDP-2-P methyl glycidic acid (PMK glycidic acid) esters as List I chemicals: - Government Buyer: - Department of Justice, Drug Enforcement Administration (DEA) - Products/Precursors Targeted: - Esters of 3,4-MDP-2-P methyl glycidic acid, including: - Ethyl ester (PMK ethyl glycidate) - Propyl ester (PMK propyl glycidate) - Isopropyl ester (PMK isopropyl glycidate) - Butyl ester (PMK butyl glycidate) - Isobutyl ester (PMK isobutyl glycidate) - sec-Butyl ester (PMK sec-butyl glycidate) - tert-Butyl ester (PMK tert-butyl glycidate) - All are chemical precursors used in illicit MDMA/ecstasy production - No OEMs or commercial vendors are named, as this is a regulatory action - Notable Requirements: - All esters, isomers, salts, and combinations thereof are regulated as List I chemicals - Registration, recordkeeping, reporting, import/export controls, and security requirements apply to all handlers - No exemptions for chemical mixtures containing any amount of these esters - No legitimate industrial uses identified for these esters - All transaction sizes are regulated (no minimum threshold) - Entities may apply for exemption of chemical mixtures, subject to DEA approval

Description

The Drug Enforcement Administration (DEA) proposes to modify the listing of the List I chemical 3,4-MDP-2-P methyl glycidic acid to include esters of this chemical, which are not currently listed elsewhere in the Controlled Substances Act (CSA). The current listing includes its salts, optical and geometric isomers, and salts of isomers. The proposed amendment will expand the listing to encompass the acid, its esters, isomers, salts, and any combinations thereof. This rulemaking aims to regulate these esters as List I chemicals due to their use in the illicit manufacture of controlled substances such as MDMA and ecstasy-like substances. Comments on the proposal must be submitted by September 2, 2026.
