1. Synopsis of the Requirement

The Government hereby submits a notice of intent to award a sole-source, firm-fixed-price contract/purchase order to the proposed contractor listed in the summary block above. It is the belief of the Government that this organization is the sole source to fulfill the need of one responsible source to satisfy the agency’s requirement. (See attached justification).

2. Regulatory and Statutory Authority

This sole-source contracting action is conducted in accordance with Federal Acquisition Regulation (FAR) Class Deviation / Revolutionary FAR Overhaul (RFO) guidelines. Under the RFO, simplified procedures for commercial acquisitions are consolidated under RFO FAR Part 12 (specifically RFO FAR 12.201-1 (Simplified procedures) and RFO FAR 12.102(a) for acquisitions valued at or below the Simplified Acquisition Threshold). The statutory and regulatory authorities permitting other than full and open competition are:

Regulatory Authority: RFO FAR 6.103-1, “Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.” Statutory Authority: 10 USC 3204(a)(1) for U.S. Coast Guard.

Requirement Summary: Services requested include further development of the MAESTRO corrosion database software and the data analysis of corrosion in USCG hull structure, and the entry of the corrosion data into the MAESTRO corrosion database developed by MAESTRO MARINE. MAESTRO Marine possesses unique qualifications and in-depth knowledge of both the software and its underlying analysis approach, which is critical for evaluating the structural integrity of U.S. Coast Guard (USCG) cutters.

4. Submission Instructions to Interested Parties

This hereby constitutes a synopsis of the items included in this requirement. This notice is NOT a request for competitive quotes or proposals, and a written solicitation will not be issued. However, responses to this notice demonstrating clear and convincing evidence that competition would be advantageous to the Government, would not be cost or time prohibitive, and would not hinder critical mission objectives will be considered. The determination not to compete this proposed contract action is solely within the discretion of the Government. Information received will be considered solely for the purposes of determining whether to conduct a competitive solicitation for future requirements regarding this program. The Government will not be responsible for any costs incurred by responding to this notice.
