Sources Sought Notice: 36C24926Q0333 This is not a request for quotes; the Government is seeking information for market research purposes only. The Department of Veterans Affairs, Network Contracting Office (NCO) 9 is seeking sources interested in and capable of providing the 3Shape TRIOS 5 products as described below. The North American Industry Classification System (NAICS) is 339114, Dental Equipment and Supplies Manufacturing; The Service Code (PSC) is 6520, Dental Instruments, Equipment, and Supplies Manufacturing. Responses to this notice shall include: 1. A positive statement of your firm s interest and capability to meet the requirements. 2. Company/individual name, size status for the above reference NAICS code, a service capability statement, SAM Unique Entity Identifier (UEI), address, point of contact and list of similar facilities in which similar items have been provided. 3. Contractors should provide information on whether they are SBA certified SDVOSB, VOSB, Hub zone, 8(a), women-owned concern. If standard company brochures will be provided as a response to this Source Sought Notice, ensure that additional information tailored to this notice is included. 4. This is not a solicitation for quotes. If a solicitation is issued, it will be announced on the Contract Opportunities website https://sam.gov at a later date, and all interested parties must respond to that solicitation announcement separately from the response to this announcement. Gray Market Prevention: 1) No gray market or remanufactured items will be acceptable. Gray market items are OEM goods sold through unauthorized channels in direct competition with authorized distributors. This procurement is for a supply contract for the purchase of new medical equipment for the OBVAMC. No remanufactures or gray market items will be acceptable.

2) Vendor shall be the OEM (Original Equipment Manufacturer) or an approved authorized distributor for the proposed supply contract for the purchase of new medical equipment to include replacement parts (if applicable), such that the OEM s warranty and service associated with the equipment and system is in accordance with the OEM terms and conditions.

3) The delivery of gray market items to the VA in the fulfillment of an order/award constitutes a breach of contract. Accordingly, the VA reserves the right to enforce any of its contractual remedies. This includes termination of the contract or, solely at the VA s election, allowing the Vendor to replace, at no cost to the government, any remanufactured or gray market item(s) delivered to James H. Quillen VAMC upon discover of such items.
