The Equal Employment Opportunity Commission (EEOC) is proposing a rule to rescind and remove the filing requirements for the EEO-1 through EEO-6 reports, as well as related recordkeeping and preservation requirements under 29 CFR part 1602. The Commission preliminarily determined that these reports are inconsistent with equal employment opportunity law and potentially unconstitutional, and that the data collected is not narrowly tailored or necessary to enforce anti-discrimination laws. The proposal includes a public hearing and invites comments by August 24, 2026. The rule also plans to incorporate previously proposed revisions related to the Pregnant Workers Fairness Act into the final rule.
