Description
The Commodity Futures Trading Commission (CFTC) is issuing a final order to sunset certain large trader reporting requirements for physical commodity swaps under Part 20 of its regulations. This order renders routine position-reporting requirements ineffective and unenforceable, eliminating the need for clearing organizations, clearing members, and swap dealers to file daily and event-based position reports. However, the Commission retains authority to require maintenance and production of underlying books, records, and futures-equivalent conversion methods on special call. This change reflects the maturity of the Commission's swap data reporting regime, which now provides comprehensive and timely data, making the Part 20 reports largely duplicative and costly to maintain.
