Description

The Commodity Futures Trading Commission (CFTC) is issuing a final order to sunset the routine position-reporting requirements of Part 20 for physical commodity swaps, effective July 21, 2026. This order renders the daily and event-based position reports currently required under Part 20 ineffective and unenforceable, while preserving the Commission's authority to require maintenance and production of underlying books, records, and futures-equivalent conversion methods on special call. The decision is based on the Commission's enhanced swap data reporting regime, which now provides comprehensive and timely data, making the Part 20 reports largely duplicative and costly for market participants. Clearing organizations, clearing members, and swap dealers will no longer be required to file these routine reports, but must retain records for special call requests.
