Description

The Environmental Protection Agency (EPA) issued a proposed rule to establish a Federal permit program for disposal of coal combustion residuals (CCR). The EPA is considering new compliance pathways allowing site-specific considerations during permitting for CCR units complying with groundwater monitoring, corrective action, and closure requirements under federal or participating-State CCR permits. The EPA is also considering whether a general permit could be developed to allow facilities to temporarily obtain permit coverage until an individual permit is issued by EPA or an approved state CCR permit program. This advance notice of proposed rulemaking does not propose or change any regulatory requirements.
