Sources Sought Notice: 19INLE26I0029 - INL Colombia Navy Tactical Equipment

Background:
INL Bogota assists the Colombian Navy and National Police providing equipment to Special Groups. Equipment will be used to develop special operations aimed at dismantling narcotrafficking structures in Colombia. This project will equip key Colombian national police and Navy units with special equipment to enable them to conduct duties related to specific counternarcotic operations.
This Sources Sought notice is issued for planning market research purposes only, and does not constitute a solicitation for proposals, offers, bids, and/or quotes. This is not an announcement of a forthcoming solicitation, or confirmation that the Government will contract for the items contained in the Sources Sought, nor is any commitment on the part of the Government to award a contract implied. Responses to this notice will assist the Government in identifying potential sources and in determining if a Small Business set-aside of the solicitation is appropriate, as well as determining if delivery of the training ammunition can be delivered within 120-days of a potential award. Respondents are advised that the Government will not pay for any information or administrative cost incurred in response to this Sources Sought. Responses to this notice will not be returned.
The following information is requested in this RFI/Sources Sought:
1. Company name, point of contact, phone number, and address;

3. Interest in nature of participation [e.g., prime contractor, teaming partner, primary subcontractor];

Technical Specifications:
All items shall be brand name or equivalent. Items manufactured in China will not be accepted.

Delivery (Shipping and Handling Instructions):
Local shipments shall be delivered to INL warehouse in Colombia, Avenida Calle 22 No. 68B Avenida Calle 22 No. 68B--75 Barrio Montevideo75 Barrio Montevideo or INL Freight Forwarder in Miami, FL. – USA.

The Contractor shall properly pack and consolidate the entire shipment to prevent damage, loss and/or misdirection. Upon notification, the contractor shall replace any items lost or damaged during shipment. Partial shipments are not allowed unless approved in writing by the Contracting Officer. The products acquired through this contract will be donated to the government of Colombia. In addition to ensuring that all items are prepared for safe shipment, the contractor shall include all the necessary export approvals, required material data safety sheets, licenses, and paperwork. One copy of the packing list and commercial invoice must accompany the shipment, attached to the outside of the “lead” or number one box/carton/package, or individually attached to the outside of each box/carton/package. The packing list shall include, at a minimum: description, brand name, serial number (if any), and quantities.
Contractor is responsible for all documentation required for export licensing in accordance with ITAR and/or DDTC license procedures to export to Colombia. The End Users will be the Colombian National Police and/or the Navy.
Warranty:
With the exception of the case (or cases) when the warranty period is an explicit requirement in the item description, all the products listed must be warrantied for at one (1) year before its due date and warranty, otherwise, the specified period will apply. If INL receives a warranty claim for any product(s), it will be sent to the vendor’s location to perform an evaluation, with no charge to INL, to verify the status of the claim and the product. If the warranty department of the vendor determines that the product has a defect covered under the warranty, vendor must replace it. INL will not be responsible for any transportation charges related to warranty service. Replacement products must be in new condition.
During the warranty period, the contractor must respond to any technical requests over the phone or e-mail within 24 hours. Items requiring warranty will be shipped back to Goldbelt. The contractor shall exercise warranty procedures within 72 hours of item (s) arrival at Goldbelt. After the warranty service is performed, the Contractor shall properly package the items per Section 3 and deliver them back to Goldbelt.
Customs Clearance and Tax Exemptions:
If applicable, the U.S. Government will assist the Contractor in obtaining customs clearance in Colombia and tax exemption certificates from the Government of Colombia in accordance with the packing, marking, and submission of documents as instructed herein.
Export License:
The Contractor shall comply with Sections 38-40 of the Arms Export Control Act (AECA) (22 U.S.C. 2778-2780) and the International Traffic in Arms Regulations (ITAR) (22 CFR Parts 120-130) as required, for the prosecution of work under this contract at no additional cost to the Government. Failure to be in compliance with AECA and ITAR by date planned for commencement of contract performance as well as during the entire performance of work under this contract may result in contract termination. Any penalties rendered to the Contractor, as a direct result of being found non-compliance with AECA and ITAR will be the responsibility of the Contractor. The contractor is responsible for producing all required paperwork and obtaining all required Export Licenses. For additional information on AECA and ITAR, see http://www.pmddtc.state.gov/.
All goods and services shall be provided with tax exemption, under no circumstance INL/DOS will be paying VAT, income, entrance or any other related tax for this order. The U.S. Government (USG) will assist the contractor in obtaining customs clearance and tax (IVA) exemption certificates from the Government of Colombia.
Inspection And Acceptance:
The final inspection and acceptance of ALL items shall be performed by the U.S. government upon their arrival in Colombia. The payment(s) to the contractor shall be made following satisfactory inspection and acceptance of products by the office of INL in Colombia. If item does not fulfill requested technical specifications, INL Bogotá will return the items to Goldbelt. Vendor shall pick up the items, evaluate and replace returned items with no transportation cost to INL. Although the items are delivered to the warehouse in Miami, the contractor must wait for the items to be transported to Bogotá, Colombia, where experts will confirm that the technical requirements of the requested products are satisfactorily met.
