Description
This final rule removes the requirements from the 2024 final rule that mandated Title IV-E/IV-B agencies to ensure designated placements for children in foster care who self-identify with an alternative sexual orientation or as something other than their sex. The 2024 rule was vacated by a court decision and never implemented. The rescission clarifies regulatory provisions by removing these requirements from the Code of Federal Regulations. The rule is effective July 14, 2026, and aims to provide clarity to the public and regulated entities regarding applicable requirements.
