Description

The Department of Justice lodged a proposed consent decree with the United States District Court for the District of Kansas regarding a lawsuit against South Bow (USA) LP and South Bow Infrastructure Operations Inc. The lawsuit concerns a December 2022 rupture of the Keystone Pipeline that discharged at least 12,937 barrels of oil into Mill Creek and adjoining shorelines in Washington County, Kansas. The proposed consent decree requires the defendants to pay a civil penalty of $26,867,789 and implement injunctive relief to reduce the likelihood of similar spills. The decree also resolves claims by the State of Kansas for civil penalties for violations of state laws. Public comments on the consent decree are invited for 30 days following the publication date.
