Description

In accordance with Federal Acquisition Regulation (FAR) Part 12, Simplified Acquisition Procedures, and Part 6.103-1(b), the US Environmental Protection Agency intends to award a sole source firm-fixed-priced Purchase Order to Thermo Electron North America for its Unity Lab Services Essential Preventive Maintenance Plan. The US Environmental Protection Agency (EPA), Office of Applied Science and Environmental Solutions (OASES), Environmental Solutions Division (ESD), located at 109 TW Alexander Drive, Durham, NC has a requirement for an annual Preventive Maintenance Service Agreement for an Ion Chromotography/Autosampler and peripheral equipment. The procurement requires a contractor that has Thermo Scientific certified technicians and Thermo Scientific original manufacturer parts. Thermo Scientific is both the manufacturer and sole distributor of the Ion Chromotography/Autosampler that EPA owns. The nature of this acquisition requires a vendor that possesses the unique capabilities of providing preventing maintenance and repair services on Thermo Electron equipment solely utilizing authorized field engineers and replacement parts. The use of non-authorized service parts and personnel can impact future service agreements, requiring recertification of the instrumentation at government expense. If another vendor services the IC/autosampler, the instrument and associate component parts would no longer be certified by Thermo Scientific. By keeping the IC/autosampler in good working condition, it prevents disruption and delay in analysis of samples which could have an adverse impact on project and program deliverables. Vendor confirmed they do not authorize 3rd parties to service their equipment. The use of 3rd parties to service their equipment would mean the warranty would be severed. NOTE: If you are an authorized distributor or equipment service/maintenance management provider, provide documentation confirming authorization and certified capability from the manufacturer to perform service/maintenance/repair on the components identified in this notice. A response to this notice without this confirmation from the manufacturer will not be considered valid. Any interested party that believes it can meet this requirement described herein may identify themselves and must provide evidence of their capability to fulfill this requirement being requested by 3:00 PM EDT on July 24, 2026. Responses must be submitted in writing to Scott Tharp at tharp.scott@epa.gov no later than the time and date noted above. Telephone responses and requests will not be accepted. All current and potential contractors shall use FedConnect which is available at https://www.fedconnect.net/FedConnect/default.htm. There is no charge to use FedConnect. FedConnect is hosted by Unison, all related questions from vendors/contractors will be answered by Unison. This notice of use of noncompetitive procedures and the intent to award constitutes a synopsis for this requirement. Responses to this notice must demonstrate clear and convincing evidence that competition would be advantageous to the Government, would not be cost or time prohibitive, and would not hinder the mission objective of this requirement. The determination not to compete this proposed contract action is solely within the discretion of the Government. Information received will be considered for the purpose of determining whether to conduct a competitive procurement. The Government will not be responsible for any costs incurred by responding to this notice.
