Description

The 414TH Contracting Support Brigade (CSB), located in Vicenza, Italy intends to negotiate and award a sole-source modification to increase the shared maximum ordering ceiling of the AE Services Multiple Award Task Order Contract (MATOC) CLIN 0001 (Unrestricted). The affected Indefinite-Delivery/Indefinite-Quantity (IDIQ) contracts are:

Description of Action:

The Government intends to increase the CLIN 0001 shared maximum ordering ceiling by $700,000.00 from $6,000.000 to $6,700,000.00. This modification is necessary to address an unanticipated surge in AE requirements to support USAG-Italy deteriorating infrastructure. This action increases only the contract ceiling capacity and does not extend the current ordering period, which concludes on 9 February 2027, nor does it alter the scope of the base contracts.

Statutory Authority:

This action will be executed on a basis of other than full and open competition (via a class Justification & Approval) pursuant to 10 U.S.C. § 3204(a)(1), as implemented by RFO FAR 6.103-1: Only one responsible source and no other supplies or services will satisfy agency requirements. The Government has determined that the existing CLIN 0001 prime contractors are the only sources capable of providing continuous performance without causing unacceptable delays and substantial duplication of costs.

Justification Rationale:

A new competitive action to fulfill these urgent requirements would result in an estimated procurement delays which would severely disrupt ongoing USAG-Italy maintenance and repair operations of the military installation supporting U.S Forces stationed in Italy. The increase in value supported by the J&A is anticipated in carrying this contract vehicle for the remaining six months necessary to put a new IDIQ in place. Furthermore, transitioning to a new vendor pool would incur substantial duplicated costs and create a significant safety risk under federal procurement and engineering guidelines, Title II/PCAS duties must be performed directly by the original Designer of Record (DoR). The DoR possesses the unique, non-transferable technical familiarity required to conduct construction inspections, review specialized material submittals, and interpret complex design schematics without introducing liability gaps or design integrity failures. Therefore, increasing the ceiling creates sufficient risk mitigation to avoid duplication of cost, reduce safety concerns and avoid unacceptable delays

While this ceiling increase is being executed on a sole-source basis, the Government will continue to foster maximum competition by competing all future task orders among the four existing prime contract holders in accordance with FAR 16.505 fair opportunity procedures. Additionally, the government intends to post a full and open competition for a new AE Services MATOC within the next six months.

This Notice of Intent is not a request for competitive proposals. However, all responsible sources may submit a capability statement or proposal which shall be considered by the agency. Interested parties must submit a capability statement demonstrating their ability to perform Architect-Engineer (AE) full-spectrum design and engineering services for the construction, repair, and alteration of diverse government facilities, ranging from residential and commercial structures to industrial, medical, and utility infrastructure.  

A determination by the Government not to compete this proposed action based on responses to this notice is solely within the discretion of the Government.
