Description
This proposed rule implements the EB-5 Reform and Integrity Act of 2022, which reforms and enhances integrity provisions for the employment-based fifth preference (EB-5) visa category for alien investors and the Regional Center Program. The EB-5 program allows eligible aliens to apply for lawful permanent resident status in the U.S. by investing in a new commercial enterprise and creating 10 full-time jobs for qualified U.S. workers. The rule includes provisions for automatic revocation of petitions for immigrant classification and updates to regulatory and procedural requirements. Public comments on the proposed rule are invited until August 31, 2026.
