Description
This is a Notice of Intent, not a request for quotation. No solicitation will be issued, and no quotations will be requested. The Department of Health and Human Services on behalf of the National Institute of Health (NIH), National Cancer Institute (NCI), intramural program (IRP), intends to award a firm-fixed-price contract to Glencoe Software, 800 Fifth Avenue, Suite 101-259, Seattle, WA 98104 for a base period from date of award to 5/31/2027 with three (3) 12- month option to renew periods for OMERO Plus Perpetual licenses. These required licenses support an open-source client/server-based image management system developed by the Open Microscope Environment (OME) consortium and supported by Glencoe via a dual licensing agreement called OMERO Plus.
This request is for the renewal of the perpetual licenses.
Justification for Sole Source
Glencoe Software has the exclusive right to provide commercial licenses providing, guarantee, warranty, indemnity and contracted support for OMERO and Bio-Formats. If a customer does not license OMERO Plus and/or Bio-Formats from Glencoe, their only other alternative is to use open-source distributions, available under open-source licenses from the OME website. These licenses give full rights for running and customizing OMERO and Bio-Formats, but contain no guarantee, warranty, indemnity or contractually guaranteed support.
Glencoe Software is the only commercial partner of the OME project. No other entity is as closely tied to OME, interacts with OME on a daily basis, or has direct access to OME’s project and strategic planning. Glencoe Software maintains exclusive control over the design and supply of components specific to their SEM systems. OEM parts are not available through resellers.
Authority
This acquisition is being conducted under the policies of FAR Part 12 – Simplified Acquisition Procedures, FAR Part 12.102. For purchases not exceeding the Simplified Acquisition Threshold (SAT), contracting officers may solicit from a single source if determined that only one source is reasonably available. Contracts awarded under FAR Part 13 are exempt from the requirements of FAR Part 6 (Competition Requirements).
Submission of Capability Statements
Interested parties capable of providing the same or similar products or services must submit a Capability Statement electronically. Responses will be considered solely for the purpose of determining whether to conduct a competitive procurement. A determination by the Government not to compete the proposed contract, based upon responses to this notice, is solely within the discretion of the Government.
