Notice of Intent to Sole Source – 7 Month FY26 Base with three 12 Month Calendar Year Options for Elevator Preventive Maintenance and Emergency Call Back Service for the Indian Health Service (IHS) Gallup Health Medical Center based in Gallup, NM
Description This is a combined synopsis/solicitation Notice of Intent to sole source for commercial services. The acquisition will be pursued as a sole-source purchase award to TK Elevator Corporation. The authority for this noncompetitive award has been waived from the Buy Indian Act (25 U.S.C. 47; 25 U.S.C. 5307), as implemented by HHSAR Subpart 326.6 and FAR 6.302-5(b)(4), which allows the HIS to limit competition to Indian Economic Enterprises (IEEs) or ISBEEs, or make a sole-source award when only one responsible ISBEE is reasonably available. Since no IEE or ISBEEs can be identified to satisfy the IHS policy objective, after Sources Sought was published with no responses, and five companies listed as having GSA contracts and being specializing in elevator services listed as Native American or Alaskan Native status were contacted via email to ask for their capabilities and confirmation of IEE or ISBEE status, and no responses were received, a Buy Indian Act (BIA) waiver was processed and approved, this announcement constitutes the only solicitation; proposals are not being requested and a written solicitation will not be issued. Only one vendor was identified to fulfill this requirement, a large business.
The Indian Health Service (HIS) within the Department of Health and Human Services (HHS) intends to award a firm-fixed-price purchase order on a sole-source basis to TK Elevator Corporation, located in Albuquerque, NM, to procure a base of 7 months of professional elevator maintenance service for the Gallup Health Medical Center.

Contractor services shall include monthly inspections of all six elevators to ensure continuous operations, and complete preventive maintenance work per current ASME A17.1 Safety Code for Elevators and Escalators, Section 8.6 requirements, and provide emergency services 24 hours a day, 365 days a year with service callbacks. (ii) Justification for Sole Source The statutory authority for this sole-source award is 41 U.S.C. 1901(a)(1) as implemented by FAR 13.106-1(b)(1)(i), permitting other than full and open competition when only one responsible source and no other supplies or services will satisfy agency requirements. TK Elevator Corporation is the only source capable of providing the required services
The Indian Health Service (IHS) is the principal federal health care provider and health advocate for Indian people, and its goal is to raise their health status to the highest possible level. IHS provides a comprehensive health service delivery system for approximately 2.3 million American Indians and Alaska Natives (AI/AN) who belong to 573 federally recognized Tribes in 37 states.

(iii) Submission Information This is not a request for competitive proposals. However, all responsible sources may submit a capability statement which shall be considered by the agency. To be considered, responses must be submitted in writing to the Point of Contact named in this notice by June 5, 2026, at 5:00 PM Eastern Time.
All capability statements must be submitted via email to the Point of Contact listed in section (iv) of this notice.
A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement.
