The Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF) proposes amending Department of Justice regulations on non-over-the-counter (NOTC) firearms sales. The proposed rule would remove restrictions limiting NOTC sales to background check-exempt transfers and permit federal firearms licensees (FFLs) to conduct NOTC transfers while complying with background check requirements. It also adds remote identity proofing and electronic notices to chief law enforcement officers, providing greater flexibility for lawful firearm purchasers. Comments on the proposed rule must be submitted by August 6, 2026.
