Description
This final rule codifies a new framework for determining distinct staple food varieties required for retailer participation in the Supplemental Nutrition Assistance Program (SNAP). It implements provisions from the Agricultural Act of 2014 that increased the minimum number of staple food varieties a SNAP retailer must carry from three to seven in each of four staple food categories, and increased the number of food categories requiring at least one perishable variety from two to three. The rule aims to ensure SNAP retailers offer a wider variety of staple foods to effectively serve SNAP participants. The rule is effective July 7, 2026, with implementation required by November 4, 2026.
