This notice from the Surface Transportation Board announces a final rule regarding civil monetary penalties for 2026: - The Board is an independent federal agency overseeing rail, motor, water, and pipeline carriers - No procurement of products or services is involved in this action - No OEMs, vendors, or commercial products are referenced - The rule implements OMB guidance, stating there will be no inflation adjustment for 2026 due to unavailable Consumer Price Index data - 2025 civil monetary penalty levels will remain in effect for 2026 - The rule applies to penalties under 49 CFR Part 1022, impacting regulated carriers but not involving acquisition of goods or services
Description
The Surface Transportation Board is revising its previously issued final rule on the annual inflationary adjustments to civil monetary penalties to conform to guidance from the Office of Management and Budget (OMB). The revised final rule reflects no cost-of-living adjustment for 2026 due to the lack of October 2025 Consumer Price Index data. The rule reinstates the 2025 civil monetary penalty levels for 2026 and is effective May 5, 2026.
