This notice provides clarification regarding the coverage of the Maryland State Plan for occupational safety and health: - The Occupational Safety and Health Administration (OSHA), part of the U.S. Department of Labor, clarifies jurisdiction for private-sector employment on federal properties in Maryland. - Private-sector employment on land or property in Maryland owned or leased by the United States or any federal entity is not covered by the Maryland State Plan. - Federal OSHA retains enforcement authority for occupational safety and health standards for private-sector workers on these federal properties. - The Maryland State Plan, administered by the Maryland Department of Labor, Division of Labor and Industry, Maryland Occupational Safety and Health (MOSH), continues to cover: - Most private-sector workers in Maryland (excluding those on federal property) - All state and local government workers in Maryland - Specific exclusions apply for federal government employers, certain federal contractor operations, and other defined categories. - No procurement, products, or services are being requested or awarded in this notice.
Description
This notice announces OSHA's approval of a clarification to the Maryland State Plan specifying that private-sector employment on land leased or held by the United States or any unit of the United States in Maryland is not included in the State Plan. The Maryland State Plan covers most private-sector and all state and local government workers but excludes federal government employers and certain other categories. Federal OSHA retains enforcement authority over private sector employment on federal properties in Maryland to ensure effective protection of workers. This clarification is effective April 27, 2026.
