Procedures for Steel and Aluminum Producers to Obtain Tariff Adjustments for New U.S. Production Capacity

The Department of Commerce, International Trade Administration, is announcing procedures for steel and aluminum producers in Canada or Mexico to apply for tariff adjustments related to new U.S. production capacity: - Government Buyer: - U.S. Department of Commerce, International Trade Administration, Enforcement and Compliance - Eligible Applicants: - Steel and aluminum producers operating in Canada or Mexico who commit to new U.S. production capacity supporting automobiles, medium- and heavy-duty vehicles (MHDVs), and their parts - Products/Services Requested: - Submission and review of detailed project documentation for new U.S. steel or aluminum production capacity - Required information includes: descriptions of steel or aluminum products, projected annual production capacity, lists of suppliers and contractors, raw material requirements, hiring plans, project milestones (land purchase, facility design, construction, equipment procurement, installation), project management plan, and quarterly progress reports - Tariff adjustments apply to: - Certain articles of steel (HTSUS 9903.82.18) melted and poured in Canada or Mexico, qualifying under USMCA - Certain articles of aluminum (HTSUS 9903.82.19) smelted and cast in Canada or Mexico, qualifying under USMCA - Unique/Notable Requirements: - Producers must demonstrate commercial practicality and compliance with project milestones - Ongoing quarterly reporting is required; noncompliance may result in termination of tariff adjustments - The Department will review submissions and notify U.S. Customs and Border Protection of approved adjustments - No specific OEMs or vendors are named; procedures are open to qualifying steel and aluminum producers - Places of Performance/Delivery: - Canada and Mexico (production) - United States (importation and government review) - The notice also references an antidumping duty administrative review for Okechamp B.V. Description

This notice establishes procedures for steel and aluminum producers operating in Canada or Mexico to submit documentation substantiating new U.S. production capacity commitments. The purpose is to obtain tariff adjustments under Presidential Proclamation 10984, which imposes additional tariffs on certain imports to address national security concerns. Eligible producers must provide detailed project information, including production capacity, suppliers, contractors, raw materials, hiring plans, milestones, and a project management plan.
