Description
The U.S. International Trade Commission has determined not to review a combined recommended determination on modification and enforcement initial determination regarding certain light-based physiological measurement devices and components. The determination found that the accused redesigned products do not infringe the asserted patents and therefore should not be excluded under the limited exclusion order. The underlying investigation involved allegations of patent infringement by Apple Inc. and resulted in remedial orders including a limited exclusion order and cease and desist order. This proceeding is now terminated with the conclusion that the accused products do not infringe the asserted patents.
