Description

The Naval Air Warfare Center Aircraft Division (NAWCAD) Lakehurst intends to conduct a limited competition between Elbit Systems, LTD (CAGE Code: 2288A), and their authorized distributors: ADS, Inc., (CAGE Code: 1CAY9), and BAE Systems Information and Electronic Systems Ingegration, Inc., (CAGE Code: 19397), for the procurement of Countermeasure Dispenser Test Sets, P/N: 188100-7001 and NSN: 4920-01-423-8143, to support the KC-130J Program. This Countermeasure Dispenser Test Set is required to perform safety and functional checks of the countermeasure dispenser system. The Government intends to solicit this requirement on a sole-source basis under the statutory authority of FAR 13.101(b), which states that contracting officers may solicit from a single source based on a determination and findings that only one source is reasonably available.

The Countermeasure Dispenser Test Set is solely manufactured and distributed by Elbit Systems LTD as the Original Equipment Manufacturer (OEM), and their authorized distributors. The OEM owns the proprietary rights to the drawing and design of this equipment, and is not selling any of the rights. Elbit Systems LTD and their distributors are the only sources with the requisite knowledge, experience, technical expertise and technical data to provide the required Countermeasure Dispenser Test Set. There are no other manufacturers or approved distributors identified that are able to meet the Government's requirement, and no other item can be sourced to meet this requirement. A solicitation will NOT be posted following the close of this synopsis, unless alternate offerors are identified.

THIS NOTICE IS NOT A REQUEST FOR COMPETITIVE PROPOSALS.

However, the Government will consider all responses received within fifteen (15) days after the date of publication of this synopsis. Registration in the System for Award Management (SAM) at https://www.sam.gov is mandatory for consideration. A determination by the Government not to open this requirement to competition based on the responses to this notice will normally be considered solely for the purpose of determining whether to conduct a competitive procurement.
