This contract action was not awarded competitively, but it is a fixed‑price contract. In accordance with FAR 6.302‑1, Only One Responsible Source, the U.S. Section of the International Boundary and Water Commission (USIBWC) determined in a formal Determination & Findings that only the incumbent, Veolia Water North America – West, LLC, could provide uninterrupted Operations & Maintenance (O&M) services at the South Bay International Wastewater Treatment Plant (SBIWTP) during the required acquisition corrective‑action period. The plant is a 24/7 critical‑infrastructure facility where any operational lapse would result in immediate environmental, public‑health, regulatory, and treaty‑compliance impacts.
The prior competitive solicitation (No. 191BWC26R0001) was canceled due to material deficiencies in the PWS, ambiguous requirements, and a significant undisclosed organizational conflict of interest (OCI), requiring a full re‑solicitation under a defensible competitive process.
The Government requires the full contract period to properly complete the next competitive procurement to be awarded upon the conclusion of this action.
The period of performance for this sole‑source contract is April 1, 2026 through March 31, 2027, with an additional two‑month option period (April 1, 2027 through May 31, 2027) to support transition to a newly‑awarded competitive successor contract if required.
These transition CLINs ensure continuity of operations and prevent degradation of mission‑essential wastewater treatment services during contractor turnover.
