Description
The Office of Personnel Management (OPM) is withdrawing a previously proposed rule published on September 21, 2020, which aimed to revise regulations governing the appointment and employment of administrative law judges (ALJs). The proposed rule would have implemented Executive Order 13843, excepting ALJs from the competitive service and updating hiring rules in light of the creation of schedule E of the excepted service for ALJs. OPM is withdrawing the proposal due to the age of comments received and because agencies have implemented the relevant executive order; OPM plans to propose regulatory changes as part of a future rulemaking.
