THIS IS A PRESOLICITATION NOTICE, NOT AN INVITATION FOR PROPOSALS.
Towing Hawser-12" Circ (4") (DIA) 12 Strand Plaited Polyester x900' with 12" Towing Couplers spliced on each end.
The Government intends to solicit to three (3) small businesses that can meet the requirement.
FAR 12.203(a) makes it clear that there is a ceiling of $350,000.00 (SAT) for oral solicitations. FAR 5.101(a)(2)(ii) makes it clear it is not needed to solicit when oral solicitations are used. Based on how the GAO interpreted both provisions in Matter of Phoenix ENv't Design, Inc., B0422950 (Dec 10. 2024), it is indeed possible that oral solicitations could potentially be used in acquisitions where the IGE was between $20,000.00 and $350,000.00 as, they indicated that 5.101(a)(2)(ii) overrode 5.101's general rule requiring that the Contracting Officer is to post for all requirements above $20,000.00.
An oral solicitation for a requirement in the $20,000.00 to $350,000.00 range depends on if the Contracting officer can satisfy the requirement of FAR 13.106-1(c)(1)(ii) that oral solicitations is "more efficient" than using electronic means.
