Description

U.S. Customs and Border Protection (CBP) intends to negotiate, on a sole source basis, with Native Energy & Technology, Incorporated in order to continue preventive maintenance and repair services in U.S. Customs and Border Protection's southeast region, under authority of FAR 6.103-1 and 41 USC 3304(a)(1).

The current contract is set to expire March 31, 2029.  The requirement is for the maintenance and repair of facilities and equipment at CBP locations in the Southeast United States, Puerto Rico and the US Virgin Islands. These services are essential in support of U.S. Customs and Border Protection operations in the southeast region, and market research identified Native Energy as the only responsible source with relevant experience in Puerto Rico and other similar remote areas. A new contractor would be required to physically validate all the equipment on the contract, which would be time-consuming, costly and logistically challenging. In this scenario, the government would be required to provide assistance by escorting contractors that have not been adjudicated background investigations ultimately disrupting critical operations.

Market research was conducted this year and will continue in future years in an attempt to find viable alternatives for a competitive award.  CBP plans to post a Request for Information in the Fall of 2027 on SAM.gov for their follow-on Southeast Regional preventative maintenance and repair contract with an anticipated award date in 2029. 

This total contract ceiling increase includes a period of performance from date of award through March 31, 2029.

The Government intends to solicit and negotiate directly with Native Energy & Technology, Incorporated.  No solicitation package will be issued. This notice of intent is not a request for competitive proposals. An award to Native Energy & Technology, Incorporated is anticipated no later than 05/01/2026.
