Federal Legislation
Congress Expands Charter School Program Grants
January 13, 2026
Congress has enacted the Empower Charter School Educators to Lead Act (H.R. 3453), which modifies the federal Charter School Program (CSP) grants administered by the Department of Education. This legislation allows state educational agencies and charter school boards to allocate up to 5% of their CSP funds for pre-planning grants to prospective charter school developers and increases technical assistance funding from 7% to 10%. The changes aim to support early-stage charter school development and increase the number of high-quality charter schools nationwide.
- The Department of Education oversees approximately $440 million in CSP grants appropriated for Fiscal Year 2025, which now include expanded funding flexibility for pre-charter planning and technical assistance.
- State educational agencies and charter school boards are key recipients and administrators of these grants, impacting procurement and grant management processes at the state level.
- Procurement professionals should anticipate increased demand for services related to charter school planning, technical assistance, and capacity building.
- Organizations involved in educational consulting, grant administration, and charter school development may find new contracting opportunities aligned with these expanded CSP provisions.
The charter school application process can be extraordinarily lengthy and complex.
