Federal Legislation
Secretary of Agriculture Authorizes Cemetery Land Conveyance
January 14, 2026
The Secretary of Agriculture has been authorized under the Small Cemetery Conveyance Act (H.R. 4284) to transfer certain cemetery parcels within National Forest System lands without monetary consideration to qualified entities, including state and local governments, Indian Tribes, and land grant-merced communities. This legislative amendment to the Small Tract Act of 1983 aims to facilitate the preservation and management of culturally significant cemetery lands, reduce federal estate management responsibilities, and support rural community interests.
- This authorization enables streamlined conveyance processes for cemetery lands, potentially accelerating land transfers and reducing administrative burdens for the U.S. Forest Service and the Department of Agriculture.
- Procurement and land management professionals should evaluate opportunities to engage with state, tribal, and local entities benefiting from these conveyances for related services such as land surveying, environmental assessments, and cultural resource management.
- The conveyance mechanism may influence future land management contracts and partnerships, particularly in New Mexico and other states with National Forest System lands containing cemetery parcels.
- Organizations involved in rural community development and cultural preservation may find new collaboration avenues with federal agencies under this amended authority.
