# GSA Implements LLM Acquisition Safeguards

GSA’s AI acquisition clause 552.239-7001 took effect October 19, 2026, for new GSA solicitations issued on or after that date when large language model functionality is material and the system processes government data. The clause establishes safeguards that include prohibiting the use of government data to train models, requiring data deletion and security notifications, and flowing applicable obligations down to subcontractors. Covered contractors also face incident-reporting deadlines of no more than 72 hours and disclosure and advance-notice requirements for changes made to comply with foreign government rules; the meaning of “non-U.S. federal government” remains unclear. GSA may add the requirements to earlier solicitations and existing contracts, so AI providers and their subcontractors should assess coverage and review contract terms now.

- Companies should inventory covered models and subcontractors, document data handling and security controls, and confirm how deletion, human oversight, auditability, testing, and suspension provisions apply to their systems.
- AI providers, including European firms that remain eligible, should assess the clause’s 30-day disclosure and advance-notice requirements for changes related to foreign government rules, including possible EU AI Act adaptations.
- Contractors should review resulting contract terms for data-location expectations, incident reporting, subcontractor flow-downs, and potential exit costs; existing GSA contracts do not necessarily adopt the clause automatically, but GSA may incorporate it.
