# OFCCP Revises Federal Contractor Compliance Rules

The Office of Federal Contract Compliance Programs (OFCCP) finalized changes removing the 7% workforce benchmark and related disability data-analysis measures from federal contractor compliance reviews. These changes do not eliminate contractors’ continuing Section 503 obligations, including affirmative action programs, outreach and recruitment, and assessment of those efforts. Plans dated before September 21, 2026, follow the prior rules; plans dated later should follow the August 21, 2026 final rules. The VEVRAA coverage threshold is now $200,000.

- Contractors should distinguish discontinued review measures from continuing statutory and regulatory duties, update compliance procedures accordingly, and retain evidence of affirmative action, outreach, recruitment, and assessments.
- **Key transition date:** Plans dated before September 21, 2026, follow prior rules; later plans should follow the new rules. Contractors should apply the appropriate framework to their plans and records.
- Contractors should document reviews of actual employment practices and assess employment decisions, including AI-assisted selection, for potential discrimination and False Claims Act exposure.
