Leavenworth County, Kansas Board of County Commissioners meeting, October 22, 2026 (the meeting title references October 21). The commission unanimously adopted Resolution 2026-22 approving standalone battery energy storage system (BESS) regulations, based on Planning Commission case DEV-26-100. The regulations include decommissioning financial-security provisions, which may be secured through mechanisms such as escrow, a bond, or an irrevocable letter of credit; project-specific amounts and terms may be addressed in development agreements. Environmental insurance was also added. Officials clarified that these rules are for standalone systems, not BESS installations treated as ancillary to a data center. No contract award or procurement was made.

A representative of the Moorish Science Temple requested a county support letter for a KDHE/K-State targeted brownfield assessment grant for an 80-acre property; commissioners requested the grant guidelines and revitalization plan before considering the request. Commissioners discussed possible tax arrangements for a proposed battery-storage project, including a precedent involving an IRB and PILOT in Wyandotte County, but said no exemption was being considered at this stage and that staff was exploring alternatives. The proposed Cloverleaf data-center application remained under review, with the applicant’s response to county comments pending; the commission agreed to consider a related letter when regulations return for approval. Commissioners also requested legal research on whether separating the data-center and power-plant applications requires a new submission, with legal advice to be addressed in executive session.
