The City of Boulder Planning Board meeting on October 20, 2026, included a public hearing on proposed Ordinance 8768, which would amend the city’s residential and commercial deconstruction and diversion requirements. Staff described proposed clarifications to prioritize material reuse, establish a process for requesting variances, and add graduated fines for contractors with repeated violations: $1,500 for a first cumulative violation, $3,000 for a second, and $6,000 for a third and potentially subsequent violations. The existing refundable deposit of $1 per square foot, with a $1,500 minimum, would not increase. Staff said the changes aim to improve compliance and diversion; the 218 projects reviewed had averaged 70% diversion, below the 75% requirement. If adopted, the changes were proposed to take effect July 1, 2027, following City Council readings and a public hearing planned for November and December.
No motion or recommendation was made. During questions, board member Max Lord disclosed that he is a general contractor and recused himself because of the direct financial impact, leaving the board without a quorum. The hearing was therefore stopped and will need to be rescheduled; the board did not take public comment or vote. No contract awards, vendor selections, or other purchasing decisions were identified.
