The City of Medford Public Works and Facilities Committee met on October 21, 2026, to discuss municipal responsibilities, liability, and funding for private ways. The committee considered a proposal to submit acceptance of Massachusetts General Laws Chapter 40, Section 6C to voters at the November 2027 city election, which would authorize snow and ice removal on designated private ways and clarify the liability treatment of that work. Members and the DPW commissioner noted that the city already provides some services on private ways—including plowing, sweeping, and emergency pothole repairs—but does not separately track those operating costs; the claim that the city had appropriated $0 was clarified as referring to dedicated capital funding. The commissioner recommended pursuing Section 6C, while noting the risk and operational uncertainty if voters reject it. The committee voted to refer the proposal to a future regular meeting and seek legal advice on how adoption would affect liability.
The committee also discussed a resolution seeking a dedicated account for private-way maintenance. Members noted that Chapter 90 aid—about $990,000 annually—is restricted to public ways, while a road and sidewalk crew funded through a tax override received $500,000 annually. The DPW commissioner advised that any private-way repair funding should be considered under the city’s existing Chapter 6N ordinance and said current public-way obligations should take priority; updating the ordinance could be considered before funding it. Rather than advance the dedicated-account request, the committee voted 5–0 to keep the matter in committee, discuss what private-way guidance and information should appear on the city website, and request legal input on whether a dedicated line item could affect liability. No contract awards or procurements were identified.
