New York City Council Committee on Health hearing on food service regulations, October 20, 2026. The committee reviewed restaurant inspection performance and staffing: DOH said it inspected about 71% of city restaurants in FY2026, with roughly 8,800 uninspected and just under 500 going at least two years without an inspection. Monthly inspection volume had risen to just under 2,700 by August 2026, but staffing remained below pre-pandemic levels. DOH described ongoing recruitment and said the staffing gap was not primarily a funding issue; it cited several hundred thousand dollars in inspector overtime. The hearing also covered food-protection certificates, inspection documentation, restaurant grades, and Legionella controls for cooling towers.
The committee discussed proposals concerning digital verification of food-protection certificates, five-year certificate renewal, nutrition standards for chain-restaurant children’s meals, relocation or reopening of certain tobacco bars, and reporting Legionella results at 10 CFU/mL or higher; a resolution addressed food additives in school food. DOH supported the intent of certificate renewal and healthier children’s meals, raised operational and record-retention concerns about certificate verification and inspection photography, and objected that allowing tobacco bars to relocate or reopen would undermine the Smokefree Air Act’s attrition approach. DOH said it would continue discussions on the Legionella reporting proposal. Public testimony included support for the children’s-meal and Legionella proposals and opposition to tobacco-bar relocation. No procurement activity, contract awards, spending approvals, or votes were identified.
